Welcome to SmartGalaxy Labs. We request you to please read all our documents such as Privacy Policy, Cancellation, Refund Policy, Terms and Conditions document before using our website.

This Customer agreement is an agreement between you (Customer, User of this site) and SmartGalaxy Labs. (Site, App, We, Us) that states the terms and conditions under which you may use the Site and receive SmartGalaxy Labs service, which may includes delivery of product orders.

These Terms and Conditions and Privacy Policy are effective upon acceptance in registration for new registering users and are otherwise effective from 11 March 2021 for all users.

By registering/signing up on our website / Mobile Application you confirm that you have read and agreed to these Terms and Conditions and the Privacy Policy. If you do not agree to these Terms and Conditions and/or our Privacy Policy, please do not register for or use SmartGalaxy Labs.

If you are under 18, you may use SmartGalaxy Labs. only with involvement of a parent or guardian.

Use of the SmartGalaxy Labs Website / Mobile Application

Purchase of the software / Mobile Application is not free of charge. You are not allowed to bypass the registration process and access the system without buying the software license. SmartGalaxy Labs does not charge any fee for browsing on the Website. In particular, SmartGalaxy Labs may at its sole discretion introduce new services and modify some or all of the existing services offered on the Website / Mobile Application. In such an event Website / Mobile Application reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be.

Non-payment

SmartGalaxy Labs reserves the right to issue a warning, temporarily / indefinitely suspend or terminate your membership of the Website/Mobile Application and refuse to provide you with access to the website/Mobile Application in case of non-payment of fees by you to SmartGalaxy Labs. SmartGalaxy Labs also reserves the right to take legal action in case of non-payment of fees by you to SmartGalaxy Labs. You shall not attempt to or circumvent or manipulate the billing process or Fees owed to SmartGalaxy Labs incorporated by way of reference in this Agreement.

Your User Account

You agree to provide SmartGalaxy Labs with accurate and complete information as required by registration for SmartGalaxy Labs Services including, but not limited to, your legal name, valid email id, billing and Shipping addresses, telephone /mobile number, Image, GPS location, Country code, which is used for new account creation and further user validation to save our application from any fake users and fake profiles. We also may Read / collect your contact numbers present in the mobile phone, this is required for proper and specific functioning of the mobile Application and give you a better user experience (eg: while you want to place an order using our App manually for your contacts, then this permission is required). You will remain liable for any use of the SmartGalaxy Labs Services until you notify SmartGalaxy Labs of the unauthorized use, loss or theft.

Usage of the Email of the User

SmartGalaxy Labs may send order confirmation & update the customer on the order status and any further order information via email given by the customer at the time of ordering / creating an account / registering an account. The customer hereby unconditionally consents such intimation by SmartGalaxy Labs in accordance with the 'Do not disturb guidelines of any authority in the respective country.

Arbitration

If any dispute arises between you and SmartGalaxy Labs during your use of the website / Mobile Application or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of the Customer Agreement, the dispute shall be referred to a sole Arbitrator, who shall be an independent and neutral third party identified by SmartGalaxy Labs. The arbitration proceedings shall be in the English language.

Indemnification

You agree to defend, indemnify and hold SmartGalaxy Labs and its Associates harmless from any claims and expenses, including attorney's fees, arising in connection with a violation of this Agreement by you or through use of your account. The limitations and exclusions in this section apply to the maximum extent permitted by applicable law.

Privacy
